MCP Server - Terms of Use

1. Acceptance 

By accessing or using the Nordic Semiconductor ASA MCP Server (the "MCP Server"), you agree to be bound by these Terms of Use ("Terms"). If you are acting on behalf of a company or other legal entity, you confirm that you have authority to bind that entity. If you do not agree, do not access or use the MCP Server. 

These Terms are subject to change. The current version is always available at https://docs.nordicsemi.com/bundle/nordic-mcp/page/index.html. Continued use of the MCP Server following an update constitutes acceptance of the updated Terms. 

2. The Service 

Nordic Semiconductor ASA ("Nordic", "we") makes publicly available development resources — including documentation, API definitions, prompts, tools, and related materials ("Materials") — accessible to your AI agent through the MCP Server. The MCP Server is provided free of charge for professional and business use only. 

Nordic does not operate or control your AI agent and has no access to any output it generates ("Output"). You are solely responsible for the configuration, operation, and output of your AI agent. 

3. Permitted Use and Restrictions 

Permitted use: You may access and use the MCP Server and Materials solely to develop, test, or evaluate software intended for use with Nordic Semiconductor ASA hardware products ("Nordic Hardware"), including by integrating the Materials with your AI agent for that purpose. 

You shall not: 

(a) use the MCP Server or Materials to develop, generate, test, or configure software or firmware for any hardware other than Nordic Hardware, including hardware manufactured by competitors of Nordic Semiconductor ASA; 

(b) use the MCP Server or Materials for any unlawful, harmful, fraudulent, or abusive purpose; 

(c) overload, disrupt, or interfere with the MCP Server or Nordic's infrastructure, or attempt to bypass or probe its security controls; 

(d) use the Materials or Output to train, fine-tune, or develop any AI competing model or competing tool or service; 

(e) engage in prompt injection, jailbreaking, or adversarial prompting directed at the MCP Server; 

(f) scrape or bulk-extract Materials beyond normal use; 

(g) allow any third party to access the MCP Server through your account or credentials; or 

(h) use the MCP Server in any way that infringes Nordic's or any third party's intellectual property rights. 

4. Intellectual Property 

Nordic retains all intellectual property rights in the Materials and the MCP Server. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Materials solely for the permitted use in clause 3. No ownership of Nordic's intellectual property is transferred to you. To the extent Output incorporates Nordic Materials (such as API structures or boilerplate), those elements remain subject to Nordic's rights and are licensed, not transferred. No licences are granted by implication or estoppel beyond what is expressly stated here. 

If you provide feedback or suggestions regarding the MCP Server, you grant Nordic a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you. 

5. Disclaimers 

THE MCP SERVER AND ALL MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. NORDIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, SECURITY, AND NON-INFRINGEMENT. NORDIC DOES NOT WARRANT THAT THE MCP SERVER WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT OUTPUT WILL BE FREE FROM ERRORS, HALLUCINATIONS, OR SECURITY VULNERABILITIES. OUTPUT DOES NOT CONSTITUTE NORDIC'S TECHNICAL ADVICE OR APPROVAL. AI SYSTEMS MAY PRODUCE INACCURATE OR HARMFUL OUTPUT EVEN WHEN USING ACCURATE INPUT MATERIALS. 

6. Limitation of Liability 

TO THE FULLEST EXTENT PERMITTED BY LAW, NORDIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, HOWEVER CAUSED. NORDIC'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS OR THE MCP SERVER SHALL NOT EXCEED EUR 100. THESE LIMITATIONS REFLECT A FAIR ALLOCATION OF RISK AND ARE AN ESSENTIAL BASIS ON WHICH NORDIC PROVIDES THE MCP SERVER FREE OF CHARGE. 

7. Your Responsibilities 

You are solely responsible for evaluating, testing, and validating all Output before use or deployment, and for ensuring that any product or system you develop complies with applicable laws, safety standards, and third-party intellectual property rights.
Safety-critical applications: The MCP Server and Materials are not designed or approved for use in safety-critical or life-support applications where failure could result in personal injury, death, or significant damage. Use in such applications is at your sole risk. 

8. Indemnification 

You shall defend, indemnify, and hold harmless Nordic, its affiliates, and their respective directors, officers, employees, and agents from all claims, costs, damages, and expenses (including reasonable legal fees) arising from: (a) your negligent or unauthorized use of the MCP Server or Materials; (b) any Output generated by your AI agent; (c) any product or system you develop using the MCP Server; or (d) any breach of these Terms. 

9. Trade Marks 

You may make factual references to Nordic Semiconductor ASA and the Nordic MCP Server when describing your development process. You shall not use Nordic's name, logo, or trade marks in any way that implies endorsement, certification, or approval of your products or Output by Nordic. Any other use of Nordic's trade marks requires Nordic’s prior written consent.  

10. Export Controls and Sanctions 

You shall comply with all applicable export control laws and regulations. You confirm that you are not located in, or a national or resident of, any country subject to applicable trade sanctions or embargoes. Use of the MCP Server from or in connection with sanctioned jurisdictions is prohibited. 

11. Privacy 

Nordic's processing of personal data in connection with your account and use of the MCP Server is governed by Nordic's Privacy Notice at https://www.nordicsemi.com/Privacy/Privacy-Policy. Nordic may log queries submitted to the MCP Server for security and compliance purposes but does not access or review Output generated by your AI agent. 

12. Confidentiality 

Nordic may have access to queries and other information you submit to the MCP Server ("Developer Input"). You acknowledge that, in order to provide the MCP Server's functionality, Nordic may transmit Developer Input to third-party services for processing, including for the purpose of retrieving or analyzing publicly available documentation. Nordic shall treat Developer Input as confidential and shall not use or disclose it other than (i) to operate, deliver, and improve the MCP Server, including through affiliates, subcontractors, or service providers bound by comparable confidentiality obligations, (ii) where required by law or order of a competent authority, or (iii) where the information becomes publicly available other than through Nordic's breach. This obligation does not apply to aggregated or anonymized data that does not identify you or your Developer Input, nor to any Materials or other information made available by Nordic through the MCP Server. 

12. Suspension, Termination, and Changes 

Nordic may suspend or terminate your access to the MCP Server at any time, with or without notice, including for breach of these Terms or risk to Nordic's systems. Nordic may modify or discontinue the MCP Server or any Materials at any time. Clauses 4, 5, 6, 7, 8, and 13 survive termination. 

13. Governing Law and Jurisdiction 

These Terms are governed by the laws of Norway. The courts of Oslo, Norway shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. 

14. General 

If any provision of these Terms is invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force. Nordic's failure to enforce any provision is not a waiver of its right to do so. You may not assign your rights or obligations under these Terms without Nordic's prior written consent. These Terms are made in English; in the event of any conflict with a translation, the English version prevails.
